1. Agreement to Terms

By accessing and using Customation A.I.'s services ("Services"), you agree to be bound by these Terms of Service ("Terms"). Customation A.I. is a company registered in Estonia, primarily serving customers in the Netherlands. If you disagree with any part of these terms, you may not access our Services.

2. Description of Services

Customation A.I. provides artificial intelligence-based automation solutions, including but not limited to:

• AI-powered automation systems
• Custom AI development services
• AI integration solutions
• AI consulting services
• AI-driven business process optimization

3. User Responsibilities

As a user of our Services, you agree to:

• Provide accurate and complete information when using our Services
• Maintain the security of your account credentials
• Use the Services in compliance with applicable Estonian, Dutch, and EU laws and regulations
• Not attempt to circumvent any security measures
• Not use the Services for any illegal or unauthorized purpose

4. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, and software, are owned by Customation A.I. and are protected by Estonian, Dutch, EU, and international intellectual property laws.

5. Payment Terms

For paid Services:

• Payments are processed in Euros (€)
• Payments are due according to the selected service plan
• All fees are exclusive of applicable VAT and other taxes
• Dutch customers will be charged the applicable Dutch VAT rate
• Refunds are subject to our refund policy
• We reserve the right to modify pricing with notice

6. Limitation of Liability

Customation A.I. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Services. This includes but is not limited to:

• Loss of profits, revenue, or data
• Business interruption
• Personal injury or property damage

7. Service Availability

While we strive to provide uninterrupted service, we do not guarantee that our Services will be available at all times. We reserve the right to modify, suspend, or discontinue any part of our Services with or without notice.

8. Data Usage and Privacy

Your use of our Services is also governed by our Privacy Policy. By using our Services, you consent to our collection and use of your information as described in the Privacy Policy, in accordance with Estonian and Dutch data protection laws.

9. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on our website. Your continued use of the Services after such modifications constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia. However, this does not affect your rights as a consumer under mandatory Dutch consumer protection laws. Any disputes shall be resolved in the competent courts of Estonia, unless Dutch law provides for mandatory jurisdiction of Dutch courts.
